PAH! App – Terms and Conditions

Welcome to the PAH! App, a platform that provides Deaf Australians with quick and easy access to Auslan interpreters. Please read the following Terms and Conditions ("Terms") carefully before using the PAH! App. By downloading, installing, and/or using the PAH! App, you agree to comply with these Terms.

If you do not agree with any part of these Terms, you must not use the PAH! App.

1. Definitions

In these Terms:

  • "App" refers to the PAH! mobile application.
  • "We," "Us," "Our" refers to PAH!
  • "User," "You" refers to individuals accessing or using the App.
  • "Interpreter" refers to Auslan interpreters who provide services via the App.

2. Eligibility

To use the App, you must be:

  • Over 18 years old, or have parental or guardian consent;
  • Legally able to enter into contracts in Australia;
  • A resident of Australia.

3. Use of the App

By using the PAH! App, you agree:

  • To provide accurate and up-to-date information;
  • Not to use the App for any unlawful or fraudulent purpose;
  • To comply with all applicable laws and regulations while using the App.

4. Services

The PAH! App allows Users to book Auslan interpreters on-demand or in advance. We provide a platform for connecting Users with interpreters but are not responsible for the services provided by interpreters.

PAH!:

  • Does not guarantee the availability or quality of interpreter services;
  • Is not liable for any disputes arising between Users and interpreters.

5. Booking and Payments

  • All bookings are subject to interpreter availability.
  • Payments for interpreter services are facilitated through the App.
  • Cancellation policies and fees will be clearly stated at the time of booking. Users are responsible for any applicable fees upon cancellation within 24 hours of the start time of the booking.

6. Privacy Policy

Our Privacy Policy, available [here] (link to Privacy Policy), explains how we collect, use, and protect your personal data. By using the App, you consent to the processing of your data in accordance with our Privacy Policy.

7. Intellectual Property

All content, features, and functionality of the PAH! App, including but not limited to text, graphics, logos, and software, are the intellectual property of PAH App Pty Ltd or its licensors. You may not copy, modify, distribute, or use any part of the App without our prior written consent.

8. User Responsibilities

Users must:

  • Use the App in good faith;
  • Ensure all provided information is accurate and up to date;
  • Follow any instructions or policies provided in the App.

Users may not:

  • Post or transmit unlawful, defamatory, or offensive content;
  • Interfere with the functionality of the App or access unauthorised areas;
  • Misrepresent your identity or relationship with any person or entity.

9. Termination

We reserve the right to suspend or terminate your access to the App if you violate any of these Terms. We may also terminate the App or any part of it at our discretion.

10. Limitation of Liability

PAH! is not responsible for:

  • Any damages or losses resulting from your use or inability to use the App;
  • The actions or services provided by interpreters;
  • Delays, interruptions, or errors in the functionality of the App.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability or fitness for a particular purpose. (Ask R what means)

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective upon posting on our website or in the App. Your continued use of the App after the changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the courts in your state or territory.
